My thoughts are keep the BMC part lose the Mustang on the logo and photoshop out the logos on the cars. No emblems at all...unless they claim they own the silhouette as well. I've seen commercials where you know it is a Chevy or Ford but they just black out or remove the logos.

well all i know is im going to keep buying ford. i actually just got a new one 2 weeks ago and love it. i do think ford is going about all of this the wrong way.

If you purchase a copier machine and remove the company emblem, does it make it LESS of that company? If you purchase a pre-recorded music CD and put a different label on it, does it change the music? Just because we remove the badges, doesn't make them LESS of a Mustang.
I agree with 99% of what has been said here thus far, but I had to jump in and ask that. Trust me, I don't see why Ford should have any say in what a private, non-profit club does with its own images as long as the club isn't profiting from, or degrading the name of the Ford company.

I sincerely hope that all the guests who are coming here to view the thread aren't under the impression that Ford has contacted us directly and that we are in a personal battle with Ford over the printing of our calendar. That would be mis-information, since the only thing that Ford has done is send a cease and desist letter to Cafe Press, the company who would profit from such a calendar and is not licensed by Ford to reprint logos, likenesses, etc...

Very True..but until we get some clarification there is no way to print any materials using any members cars because the issue is they are trademaks of Ford and someone..whoever prints them will make a profit from us paying them to make the clandar, t shirt, hat etc...even if we give them away for free, the company making them for us is making a profit, so the old legal slippery slope is involved...where does it start and where does it stop? Bottom line is there is no way to print or make any merchandise for the club and its members without someone profiting from it..no company works for free. It is a very slippery slope...so a Ford Performance shop cannot use a pic of its engine to advertise what they do, a club cannot get an event shirt made....it can go on and on once you get on that slope it is hard to get off.

I will say this...it appears there are less Mustang related items for sale on CafePress today vs yesterday..in fact I clicked on a few that worked yesterday and today they say they are not available. So I do not doubt that the issue is with CafePress, but my question is where does it stop and where does it end....

I will be in contact with Ford though ... I'm not going to continue printing something after being warned (through CafePress or otherwise) that it infringed upon what Ford feels is their right, and only their right to produce. Ignoring this and proceeding as if it's not our problem solely because of who told us would be irresponsible and cause for Ford to come after us in a very real way. I'm going to act as responsibly as possible on behalf of the BMC and all the other owners who wish to express their right to buy items with their car's image, and will make sure we, the BMC, are in compliance and remain a respected group of enthusiasts!

The poll I put on unitedstangs.com now shows 14 against Ford, 3 backing Ford, and 3 undecided.

it says somewhere:
"there are specific guidelines that allow Clubs to use the Ford trademarks and sell them only to their members. However, at this time Ford does not want to allow these sales to go through Cafepress where the sales of these products are being made available to the public."


if that's all that's needed, it's still managable i guess
